License Agreement
NOTICE WE ARE WILLING TO LICENSE THE ENCLOSED SOFTWARE TO YOU ONLY ON
THE CONDITION THAT YOU ACCEPT ALL OF THE TERMS CONTAINED IN THIS
LICENSE AGREEMENT.PLEASE READ THE LICENSE AGREEMENT CAREFULLY BEFORE INSTALLING THIS SOFTWARE. BY INSTALLING THIS SOFTWARE YOU AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO THESE TERMS WE ARE UNWILLING TO LICENSE THE SOFTWARE TO YOU AND YOU SHOULD NOT INSTALL IT. IN SUCH CASE, PROMPTLY RETURN THE UNOPENED DISK PACKAGE AND ALL OTHER MATERIALS IN THIS PACKAGE ALONG WITH PROOF OF PAYMENT, TO THE AUTHORIZED DEALER FROM WHOM YOU OBTAINED IT FOR A FULL REFUND ON THE PRICE YOU PAID, AND DELETE ALL COPIES OF ANY DOWNLOADED FILES.
DEFINITIONS
The following definitions apply to the terms as they appear in this agreement.
* Software means the specified version of the computer program enclosed, and all updates to the computer program. The term also includes all copies of any part of the computer program.
* Documentation means the user’s manual(s) and other materials accompanying the Software.
* Product means the Software and Documentation.
* Use means loading the Software into RAM or installing it on a hard disk or other storage device.

COPYRIGHT PROPRIETARY PROTECTION
The Product is owned by Ayerware Publishing or it’s licensors and is protected by United States and international copyright laws and international treaty provisions. You must treat the Product like any other copyrighted material, except to the extent that this License provides to the contrary. Your right to use the Product terminates automatically if you violate any part of this License or destroy all copies of the Product.
LICENSE GRANT
This License determines your rights with respect to the Software. You may:
* Use one copy of the Software on a single computer, provided that the Software is in use on only one computer at a time. If you have multiple Licenses for the Software, then at any time you may use as many copies of the Software as you have Licenses. If the number of persons who can access and use the Software exceeds the number of Licenses you have, then you must have a reasonable mechanism or process in place to ensure that the number of persons using the Software at the same time does not exceed the number of Licenses.
* Make one copy of the Software for archival purposes, or copy the Software onto the hard disk of your computer and retain the original for archival purposes.
LICENSE RESTRICTION
You may not:
* Copy the Documentation or merge the Software with another program or modify the Software, except as may be specifically described in the Documentation. Any modifications to the Software are subject to this License.
* Reverse-engineer, disassemble, decompile, or make any attempt to discover the source code of the Software.
* Sublicense, rent, transfer or lease any portion of the Product.
LIMITED WARRANTY
Ayerware Publishing represents and warrants that for a period of 90 days from your receipt of the Product:
(1) the disks on which the Software is distributed will be free from defects in materials and workmanship: and
(2) the Software will perform substantially in accordance with the Documentation. Any written or oral information or advice given by Ayerware Publishing’s dealers, agents, or employees will in no way increase the scope of this warranty.
If the Product fails to comply with the warranty set forth above, Ayerware Publishing’s entire liability and your exclusive remedy will be Ayerware Publishing’s reasonable effort to make the Product meet the warranty set forth above. This limited warranty applies only if you return all copies of the Product, along with a copy of your paid invoice, to Ayerware Publishing within 90 days of the date you received the Product. If Ayerware Publishing is unable to make the Product conform to the above warranty, Ayerware Publishing at its option, will refund all or a fair portion of the price you paid for the Product. These remedies are not available outside of the United States and Canada.
WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR WARRANTY DISCLAIMER: WE DO NOT WARRANT THAT THIS SOFTWARE WILL MEET YOUR REQUIREMENTS OR THAT ITS OPERATION WILL BE UNINTERRUPTED OR ERROR-FREE. WE EXCLUDE AND EXPRESSLY DISCLAIM ALL EXPRESS AND IMPLIED WARRANTIES NOT STATED HEREIN, INCLUDING THE IMPLIED PURPOSE.
NO LIABILITY FOR CONSEQUENTIAL DAMAGES
In no event shall Ayerware Publishing or it’s licensors be liable for any damages whatsoever (including, without limitation, damages for loss of profits, business interruption, loss of information, or other loss) arising out of the use of or inability to use the Product, even if Ayerware Publishing or it’s licensors has been advised of the possibility of such damages.
This Agreement shall be construed, interpreted and governed by the laws of the State of New York. This is the entire agreement between us relating to the contents of this package, and supersedes any representations concerning the contents of this package.
